Data protection information pursuant to Art. 13, 14 DSGVO -

The following is an overview of the processing of your personal data in the context of the use of the database of the Census project and your data protection rights.

1. What data is processed and for what purposes, by which persons and on what legal basis?

Website visit:

• Types of data processed: communication data (e.g. browser types and versions, operating system, the website from which an accessing system arrives at our website (so-called referrer), the sub-websites that are accessed via an accessing system on our website, the date and time of an access to the website, the Internet protocol address (IP address) reduced by the last digit for anonymisation and other similar data and information that serve to avert danger in the event of attacks on our information technology systems).

• Data subjects: Website visitors.

• Purposes of the processing: Provision of the web offer.

• Legal grounds: Processing is necessary for the purposes of the legitimate interests of the controller or a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require the protection of personal data. The interest lies in the provision offered by the website and the security of the website.

• Log data are stored for a period of 7 days.

Registration as a user:

When registering, we process user data to create a user profile.

• Types of data processed: title, first and last name, e-mail address. Optionally, further details can be added to the profile (display name, contact details). In addition, successful and unsuccessful login attempts are processed along with the time and IP address.

• Purposes of processing: creation of a user profile, storage of search history.

• Legal basis: Registration is voluntary and based on your consent pursuant to Art. 6 (1) a) DSGVO. You can revoke your consent at any time with effect for the future; the revocation does not affect the lawfulness of the processing prior to the declaration of revocation. • In the case of ongoing use, the data will be stored until revocation or discontinuation of the offer. Registered user profiles that have not been active (logged in) for more than 3 years will be deleted.

1. Who is the recipient of your data? Your data will not be passed on to third parties. For processing, we use an external service provider who processes the data on our behalf and according to our instructions within the framework of a contract processing agreement pursuant to Art. 28 DSGVO. 2. Will your data be transferred to a third country or an international organisation? No data will be transferred to a third country or an international organisation.

3. Is there an obligation for you to provide data? You provide all information voluntarily, there is no obligation to provide data.

4. Is there any automated decision making including profiling? There is no automated decision-making pursuant to Art. 22 DSGVO.

5. You have the following rights: If your personal data is processed, you have the right to obtain information about the data stored about you (Art. 15 DSGVO). If inaccurate personal data is processed, you have the right to rectification (Art. 16 GDPR). If the legal requirements are met, you can request the deletion or restriction of processing (Art. 17 and 18 DSGVO). Under certain conditions, you have the right to have the personal data concerning you that you have provided to us transferred to you in a structured, commonly used and machine-readable format, if the processing is based on consent or a contract and is carried out using automated processes (Art. 20 DSGVO). If the processing is based on your consent (Art. 6 para. 1 a or Art. 9 para. 1 a DSGVO), you have the right to revoke your consent at any time and without giving reasons for the future. The revocation does not affect the lawfulness of the processing prior to the revocation of the consent. After revocation, your user profile will be deleted and you will no longer be able to access your search history. To revoke your consent, please contact the above-mentioned contact. Insofar as processing is carried out on the basis of Art. 6 para. 1 letter e DSGVO and Art. 6 para. 1 letter f DSGVO, you have the right to object to the processing of personal data relating to you at any time for reasons arising from your particular situation (Art. 21 DSGVO). If you object, your personal data will no longer be processed unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the assertion, exercise or defence of legal claims. The objection can be lodged without any formalities. For reasons of proof, we kindly ask you to send the objection by post or e-mail. Please use the subject "Objection".

6. If you are of the opinion that the processing of personal data concerning you violates data protection regulations, you have the right to lodge a complaint with a data protection supervisory authority, for example with the Berlin State Commissioner for Data Protection and Freedom of Information (Art 77 DSGVO). 1. Welche Daten und für welche Zwecke werden die Daten von welchen Personen auf welcher Rechtsgrundlage verarbeitet?

Website-Besuch:

• Verarbeitete Datenarten: Kommunikationsdaten (z.B. Browsertypen und Versionen, Betriebssystem, die Webseite, von welcher ein zugreifendes System auf unsere Webseite gelangt (sogenannte Referrer), die Unterwebseiten, welche über ein zugreifendes System auf unserer Webseite angesteuert werden, das Datum und die Uhrzeit eines Zugriffs auf die Webseite, die zur Anonymisierung um die letzte Stelle reduzierte Internet-Protokoll-Adresse (IP-Adresse) und sonstige ähnliche Daten und Informationen, die der Gefahrenabwehr im Falle von Angriffen auf unsere informationstechnologischen Systeme dienen.).

• Betroffene Personen: Websitebesucher.

• Zwecke der Verarbeitung: Bereitstellung des Webangebots.

• Rechtsgrundlagen: Die Verarbeitung ist zur Wahrung der berechtigten Interessen des Verantwortlichen oder eines Dritten erforderlich, sofern nicht die Interessen oder Grundrechte und Grundfreiheiten der betroffenen Person, die den Schutz personenbezogener Daten erfordern, überwiegen. Das Interesse liegt dabei in der Bereitstellung des Webangebots im Rahmen der Aufgabenerfüllung der Stelle und der Sicherheit des Angebots.

• Die LogDaten werden für eine Dauer von 7 Tagen gespeichert.

Registrierung als Nutzer:in Bei Registrierung verarbeiten wir Nutzerdaten zur Anlage eines Nutzer:innen-Profils.

• Verarbeitete Datenarten: Anrede, Vor- und Nachname, E-Mail-Adresse. Optional können weitere Angaben dem Profil (Anzeigename, Kontaktdaten) hinzugefügt werden. Zudem werde erfolgreiche und erfolglose Login-Versuche mit Zeitpunkt und IP-Adresse verarbeitet.

• Zwecke der Verarbeitung: Einrichtung eines Nutzerprofils, Speicherung der Suchhistorie

• Rechtsgrundlagen: Die Registrierung ist freiwillig und beruht auf Ihrer Einwilligung gem. Art. 6 Abs. 1 a) DSGVO. Sie können die Einwilligung jederzeit mit Wirkung für die Zukunft widerrufen, der Widerruf berührt nicht die Rechtmäßigkeit der Verarbeitung vor Erklärung des Widerrufs. • Bei fortlaufender Nutzung werden die Daten bis zum Widerruf oder der Einstellung des Angebots gespeichert. Registrierte Nutzer:innen-Profile, die länger als 3 Jahre nicht aktiv (eingeloggt) waren, werden gelöscht.

1. Wer ist Empfänger Ihrer Daten? Ihre Daten werden nicht an Dritte weitergeben. Bei der Verarbeitung bedienen wir uns eines externen Dienstleisters, der die Daten in unserem Auftrag und nach unseren Weisungen im Rahmen eines Auftragsverarbeitungsvertrages gem. Art. 28 DSGVO verarbeitet. Dies ist die Programmfabrik GmbH, Schwedter Str. 9B, 10119 Berlin.

2. Werden Ihre Daten in ein Drittland oder an eine internationale Organisation übermittelt? Es erfolgt keine Übermittlung der Daten an ein Drittland oder eine internationale Organisation.

3. Gibt es für Sie eine Pflicht zur Bereitstellung von Daten? Alle Angaben stellen Sie freiwillig zur Verfügung, es besteht keine Pflicht zur Bereitstellung von Daten.

4. Besteht eine automatisierte Entscheidungsfindung einschließlich Profiling? Es wird keine automatisierte Entscheidungsfindung gem. Art 22 DSGVO durchgeführt.

5. Ihnen stehen folgende Rechte zu: Werden Ihre personenbezogenen Daten verarbeitet, so haben Sie das Recht, Auskunft über die zu Ihrer Person gespeicherten Daten zu erhalten (Art. 15 DSGVO). Sollten unrichtige personenbezogene Daten verarbeitet werden, steht Ihnen ein Recht auf Berichtigung zu (Art. 16 DSGVO). Liegen die gesetzlichen Voraussetzungen vor, so können Sie die Löschung oder Einschränkung der Verarbeitung verlangen (Art. 17 und 18 DSGVO). Sie haben unter bestimmten Voraussetzungen ein Recht auf Übertragung der Sie betreffenden personenbezogenen Daten, die Sie uns bereitgestellt haben, in einem strukturierten, gängigen und maschinenlesbaren Format, wenn die Verarbeitung auf einer Einwilligung oder einem Vertrag beruht und mit Hilfe automatisierter Verfahren erfolgt (Art. 20 DSGVO). Soweit die Verarbeitung aufgrund Ihrer Einwilligung geschieht (Art. 6 Abs. 1 a bzw. Art. 9 Abs. 1 a DSGVO), steht Ihnen das Recht zu, die Einwilligung jederzeit und ohne Angabe von Gründen für die Zukunft zu widerrufen. Der Widerruf berührt hierbei nicht die Rechtmäßigkeit der Verarbeitung vor dem Widerruf der Einwilligung. Nach Widerruf wird Ihr Nutzerprofil gelöscht, Sie können dann nicht mehr auf Ihre Suchhistorie zurück greifen. Wenden Sie sich für den Widerruf bitte an den o.g. Kontakt. Soweit die Verarbeitung aufgrund von Art. 6 Abs. 1 Buchstabe e DSGVO und Art. 6 Abs. 1 Buchstabe f DSGVO erfolgt haben Sie das Recht, aus Gründen, die sich aus Ihrer besonderen Situation ergeben, jederzeit gegen die Verarbeitung Sie betreffender personenbezogener Daten Widerspruch einzulegen (Art. 21 DSGVO). Legen Sie Widerspruch ein, werden Ihre personenbezogenen Daten nicht mehr verarbeitet, es sei denn, wir können zwingende berechtigte Gründe für die Verarbeitung nachweisen, die Ihre Interessen, Rechte und Freiheiten überwiegen, oder die Verarbeitung dient der Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen. Der Widerspruch kann formfrei eingelegt werden. Aus Nachweisgründen bitten wir Sie, den Widerspruch per Post oder E-Mail mitzuteilen. Bitte verwenden Sie den Betreff „Widerspruch“.

6. Sofern Sie der Ansicht sind, dass die Verarbeitung der sie betreffenden personenbezogenen Daten gegen Datenschutzbestimmungen verstößt, haben Sie das Recht zur Beschwerde bei einer Datenschutzaufsichtsbehörde, zum Beispiel bei der Landesbeauftragten für Datenschutz und Informationsfreiheit Berlin zu (Art 77 DSGVO).
